The Supreme Court just rejected Trump’s executive order to end birthright citizenship, reaffirming what has been settled constitutional law for more than 150 years: If you are born in the United States, you are a citizen.1
This is a victory for millions of families and for the simple principle that no president can unilaterally decide who gets to be an American.
But, Cassandra, this case should never have made it to the Supreme Court in the first place. Trump’s executive order was unconstitutional from the moment he signed it. Lower courts repeatedly blocked Trump’s order because the 14th Amendment is clear and does not give presidents the power to rewrite citizenship rights. Yet the Trump administration pushed forward, banking on a sympathetic Supreme Court to grant that power anyway.

Trump’s allies in Congress have been pushing the same attack through constitutional amendments and legislation aimed at ending birthright citizenship. Today’s ruling stopped one attempt to erase a constitutional right, but anti-immigrant politicians are continuing their campaign to rewrite who gets to be an American.
This attack was never just about birthright citizenship. It is part of the same anti-immigrant agenda that has fueled reckless ICE raids separating families, people disappearing into detention without due process, children afraid to go to school, and ICE killing our neighbors in broad daylight. Birthright citizenship was just one target in a broader extremist agenda built on scapegoating, division, and the belief that some people deserve fewer rights than others. That agenda threatens not only immigrant families but the fundamental rights and freedoms of all of us.
If we want to stop future attacks on our immigrant neighbors, we must build the political power necessary to defeat the politicians driving them.
